Terms of service

§1 Definitions

Business days – days from Monday to Friday, excluding public holidays in Poland.
Consumer – a person who is a consumer within the meaning of the Polish Civil Code.
User Account – a free function of the Store (service) that allows the Buyer to create an individual user account in the Store, regulated by a separate set of rules available in the Store.
Buyer – any entity making purchases in the Store.
Entrepreneur – an entity that is not a Consumer.
Regulations – these terms and conditions.
Registered office – the Seller’s registered address indicated in these Terms.
Store – the online store pleasantevil.pl, operated by the Seller at Władysława Jagiełły 58, 38-200 Jasło, Poland.
SellerHYPE SERVICE sp. z o.o., registered in Poland in the Central Register and Information on Economic Activity (CEIDG), with its registered office at Władysława Jagiełły 58, 38-200 Jasło, VAT ID: PL6852351236, REGON: 525475780.
Goods – movable items and digital content offered by the Seller via the Store.
Sales Agreement – a distance contract concluded between the Buyer and the Seller through the Store.

The Seller informs that standard call rates apply according to the telecommunications operator used by the Buyer. Please note that international call costs may differ depending on the Buyer’s operator’s rates.


§3 Placing an Order

To conclude a Sales Agreement via the Store, the Buyer must first add the selected Goods to the cart and, where applicable, specify their parameters.
The Buyer then provides their data (including the shipping address), chooses the delivery method, and selects the payment method.
When the Buyer confirms the order and accepts these Terms, the Sales Agreement is concluded.
The Buyer may create a User Account in the Store, but it is not required to place an order.


§4 Order Cost

Prices displayed in the Store are gross prices, i.e. they include VAT applicable in the respective country.
The total price of the order consists of the gross price of the Goods and the delivery cost, both visible during checkout.
If additional charges may apply to Buyers outside Poland, such information will be displayed during the order process before the Sales Agreement is concluded.


§5 Payments

For the Goods purchased in the Store, the Buyer may pay—depending on the selected method—via:

  • the online payment platform Paynow,

  • Shopify Payments,

  • a bank transfer to the Seller’s account,

  • a payment card.

Detailed information on available payment methods will be provided to the Buyer during checkout before concluding the Sales Agreement.
If the Buyer chooses one of the payment methods listed above (Paynow or Shopify Payments), payment must be made within 14 business days from the conclusion of the Sales Agreement.


§6 Order Fulfilment

Goods purchased in the Store are delivered via courier companies or Poczta Polska, depending on the delivery country. Details on available shipping options for each country are provided in the Store.
Digital content is delivered by providing a download link.
Delivery costs are displayed during checkout.
All documents related to the transaction will be sent to the Buyer’s e-mail address provided during order placement, to which the Buyer agrees.
The total fulfilment time, counted from the conclusion of the Sales Agreement, includes both dispatch time and delivery time.
Dispatch time is 2 business days.
If an order includes multiple products, the fulfilment time equals that of the product with the longest delivery time.
If the Buyer chose advance payment, order processing begins after the Seller receives payment.
The Seller is obliged to deliver Goods free of defects.
The Buyer may choose the form of sales document (receipt or invoice) during checkout.
The Seller will provide the Consumer with confirmation of the concluded Sales Agreement on a durable medium at the latest upon delivery of the Goods.


§7 Withdrawal from the Agreement

A Buyer who has concluded a Sales Agreement may withdraw from it within 14 days without giving any reason and without incurring costs, under the terms of Chapter 4 of the Polish Consumer Rights Act.
This right applies to both Consumers and Entrepreneurs, regardless of the type of Goods, unless a longer withdrawal period is indicated in the product description.

The withdrawal period begins:

  • for an agreement under which the Seller delivers an item – upon the Buyer (or a third party other than the carrier) taking possession of the item;

  • for an agreement covering multiple items delivered separately or in parts – upon taking possession of the last item or part;

  • for agreements for regular delivery of items – upon taking possession of the first item;

  • for other agreements – on the date of conclusion of the agreement.

The Buyer may withdraw from the agreement by submitting a withdrawal statement to the Seller, using the template provided as an appendix to these Terms.
Refunds will be made via bank transfer to the account indicated by the Buyer.


§8 Complaints

In the event of a defect in the Goods, the Buyer has the right to file a complaint based on the warranty provisions of the Polish Civil Code.
Complaints should be submitted by e-mail to kontakt@pleasantevil.pl or in writing.
If the Goods are covered by a guarantee, information about it will be provided in the product description.
Complaints concerning the functioning of the Store should also be sent to kontakt@pleasantevil.pl.
Complaints are processed within 14 business days.

§9 Personal Data

The Seller is the controller of the Buyer’s personal data provided during the use of the Store.
The Buyer’s personal data are processed on the basis of the contract and for its performance, in accordance with the General Data Protection Regulation (GDPR).
Detailed information on data processing is available in the Store’s Privacy Policy.


§10 Technical Requirements

To use the Store, an Internet-enabled device with a web browser is required.
To make purchases, an active e-mail account is also necessary.


§11 Final Provisions

The Sales Agreement concluded under these Terms applies to a specific, one-time order and is valid for the duration of its fulfilment. Each order requires separate acceptance of these Terms.
The agreement is governed by Polish law, provided that this choice does not deprive the Consumer of protection under mandatory provisions that would apply in the absence of such a choice.
In the event of a dispute between the Seller and a Buyer who is not a Consumer, the competent court shall be the court having jurisdiction over the Seller’s registered office.
Contracts related to the Store are concluded in Polish.
It is prohibited for the Buyer to provide unlawful content.
